Charter Terms & Conditions

By paying the initial deposit, the Charterer agrees to the Terms and Conditions on behalf of themselves and any other passenger on the cruise.

Agreement to Let and Hire

  • Aquaholics’ day time trips are 10:00am - 5:00pm and evening trips 7:00pm - 11:00pm unless alternative arrangements have been discussed and agreed by Us. 

  • The standard rental time is 7 hours for a day trip and 4 hours for an evening trip. The maximum travel time (boat underway) between pick-up and drop off shall not exceed 4 hours, otherwise overtime (fuel) charges will be charged.

  • Aquaholics’ pick up points are Sai Kung Public Pier, Pak Sha Wan Public Pier or at an alternative pick up destination (in Sai Kung) as discussed and agreed with Us. We do not operate or pick up on Hong Kong Island. 

  • Pick up and drop off points should be agreed at the time of booking and will be assumed to be the same. Different drop off points must be agreed at the time of the booking (not on the day of the charter). 

  • Our ability to go to outlaying areas such as Tai Long Wan, Double Haven and other such places will be subject to weather conditions and the Captain’s confirmation that it will be safe regardless of agreements made during booking submission. 

  • Charter fees as stated on our website are non-negotiable.

 

Bookings & Reservations
 

  • All bookings must be made through our booking form on our website.

  • A booking form submission does not guarantee a secured reservation. 

  • A charter booking is only secured upon payment of the invoiced deposit.

  • For bookings made within 7 days of the booking date, the full charter fee shall be paid to secure reservation.

  • Deposits for charter bookings are non-refundable.

 

Weather

  • Charters can be postponed to a future date if the weather condition warnings stated in Clause 3.1 are issued within two hours of the agreed pick up time. The Charterer will be notified of the final decision made by the Captain and may re-book within a 12 month period from the original charter date, subject to availability, based on the original charter fee. 

  • If a Typhoon signal no. 3 or above is hoisted during the charter, the Captain will return to safe anchorage or disembark passengers at the pier. There will be no refund or compensation for unused charter time.

  • If the weather becomes dangerous or unpredictable during the charter, it will be at the Captain’s sole discretion to take the vessel to safe harbour, away from danger. There will be no refund or compensation for unused travel time.

  • The charter cannot be changed or cancelled for rain, Typhoon signal no.1, thunder warnings, yellow rain warnings or any other unfavourable weather conditions. If the Charterer insists on cancelling the cruise due to such weather conditions, any monies paid including the booking deposit will be forfeited.

  • Aquaholics will not operate under Typhoon signal no. 3 or above, Red, Black rainstorm warnings or higher adverse weather conditions.
     

Breakdown and Disablement 
 

  • If the vessel has a mechanical fault before pick up and repair cannot be made on time, Aquaholics will inform the Charterer as soon as possible and either provide a boat similar to the type of boat chartered as a substitute (subject to availability) or provide a full refund to the Charter.

  • If the vessel has a mechanical fault during the trip, passengers will be returned to land by whichever means possible. If the boat has spent more than half of its scheduled time during the charter and the destination has already been reached, no compensation will be given. Otherwise, a full refund will be given to the Charter.
     

Cancellation and Re-booking
 

  • In compliance with Hong Kong law, Vessel 31736 is fully skippered with a licensed Captain provided. The Captain of the vessel has full discretion regarding trip cancellation, postponement, pick up and drop off points and time, destinations, course and any other matter relating to the charter.

  • Aquaholics reserves the right to reschedule, amend or cancel the booking due to unexpected equipment/mechanical failure or unforeseen weather circumstances.

  • If the Charterer decides the weather is not suitable and fails to arrive at the embarkation location within 2 hours of the agreed pick up time, no refund will be given.

  • If Aquaholics decides to cancel a charter, we will reschedule in line with the Charterer’s preferences, subject to availability. Aquaholics will contact the Charterer at least 2 hours before pick up time. The Charterer will therefore need to provide suitable contact details when booking.

  • The Charterer may cancel their booking and receive refunds in accordance to the following: 
     

  • Cancellation 4 weeks or more prior to charter: 100% deposit retained as credit to book another date, subject to availability, within a 12 month period (Any additional payment over and above the deposit will be refunded)

  • Cancellation made 10 days or more (but less than 4 weeks) prior to charter: 100% of the booking deposit will be charged and any additional payment over and above the deposit will be refunded 

  • Cancellation within 10 days prior to charter: 50% of the agreed charter fee will be charged

  • Cancellation within 3 days prior to charter: 80% of the agreed charter fee will be charged

  • Cancellation within 24 hours prior to charter: 100% of the agreed charter fee will be charged

 

Observance of the Law and Onboard Safety
 

  • Onboard safety is of paramount importance to Aquaholics and we reserve the right to return the vessel to the closest public pier following any dangerous or reckless behaviour onboard by any passenger.

  • The Charterer and passengers shall afford the Captain and crew due respect at all times and shall obey any lawful request by the crew relating to vessel safety or the security of passengers.

  • The Charterer shall ensure that all passengers comply with all the laws and regulations of Hong Kong during the cruise.

  • If the Charterer or any of the passenger commits any offence contrary to the laws of Hong Kong or cause damage to the boat or any of its equipment, the Charterer shall be held responsible and indemnify Aquaholics against all loss, damage and expense incurred as a result.

  • The Charterer is responsible for limiting the number of passengers to within the maximum capacity of the vessel. 

  • The Charterer is responsible for providing Aquaholics with an accurate passenger manifest at least 24 hours prior to scheduled pick up time. Any last minute deviation from this passenger manifest must be notified to Aquaholics or the Captain as soon as is reasonably possible.

 

General Rules and Regulations
 

  • Aquaholics has a no pet policy.

  • Smoking is strictly prohibited anywhere inside the vessel, although smoking is permitted out on the decks.

  • Bringing, supplying or using any illegal substances, firearms or fireworks on board is strictly prohibited.

  • For the safety of all passengers, whilst the boat is moving under power, there will be no dancing, running or jumping onboard the vessel and no swimming, diving or jumping off the decks.

  • The Charterer shall ensure there will be no swimming by any passengers who are under the influence of illegal substances or excessive alcohol and in any situation as instructed by the crew.

  • While the Crew will endeavour to supervise and monitor swimming and passenger activity, entering the water will be at the passengers own risk. Aquaholics shall not be held liable or accountable for any death or injury of passengers. 

  • Aquaholics is under no obligation to refund any charter fees or assume any liability should a passenger become ill or seasick during the cruise.

  • Any damage to the vessel, unauthorised removal of items belonging to the vesel or loss caused by breach of these Terms and Conditions will be charged to the Charterer. The repair costs must be settled before the Charterer leaves the vessel.

  • Aquaholics reserves the right to change the course of a planned charter, including pick up or drop off points.

  • Water toys including but not limited to inflatable platforms, paddle board, kayak, trampoline, noodles are subject to availability. Aquaholics is under no obligation to refund any charter fees or provide advance notices to the Charterer if any of the water toys are unavailable.

  • The Charterer and its passengers need to comply with Section 6(5)(b) of the Merchant Shipping (Local Vessels) (Certification and Licensing) Regulation; the vessel is only to be used for exclusively leisure or pleasure purposes and not any commercial or illegal purposes, and the vessel must remain within Hong Kong territorial waters at all times.

  • Aquaholics and its Crew reserves the right to immediately terminate any charter without compensation or consultation under the following circumstances:
    - Underage drinking
    - Excessive alcohol consumption by any passenger
    - Disorderly or illegal activity
    - Reckless behaviour putting other passengers, Crew and Captain at risk
    - Passengers behaving in a manner likely to damage or risk damage to the vessel, facilities or equipment on board
    - Failing to abide by these Terms and Condition

 

Catering
 

  • Aquaholics does not provide a catering service. It is the responsibility of the Charterer and its passengers to arrange and bring their own food and drink.
     

Attire
 

  • The charterer will ensure passengers do not wear swimming costumes with any hard and sharp sequins or other embellishments, which may cause damage to the vessel’s seating, the inflatable water toys and other equipment.

Personal Property
 

  • Passengers are solely responsibility for themselves, their personal safety and their personal property that they may bring aboard the vessel. If there is loss or damage of personal property onboard the vessel, neither Aquaholics nor its staff will be held responsible.
     

Insurance
 

  • Aquaholics has 3rd party insurance in terms of the Marine Legislation in Hong Kong but does not hold cover in respect of personal injury or loss of property in respect of the Charterer or its passengers. Therefore, Aquaholics takes no responsibility for damages, theft or personal injuries during boarding, the duration of the charter or at the time of disembarkation. The charterer and its passengers travel at their own risk and may consider taking out their own insurance for such purposes.

  • Aquaholics’ insurance policy does not cover any services that are provided by a third party services provider, such as food and beverage suppliers, speedboat for water sports or shuttle bus hires. Aquaholics will not be held liable for death, personal injury, loss or damage to property howsoever. The Charterer and passengers bear their own risk and may consider taking out their own insurance.

 

Medical
 

  • The charterer agrees to advise Aquaholics in advance, in writing of any medical disability or illness (including allergies, and existing medical conditions) effecting any passengers. It shall be at the discretion of Aquaholics to refuse to accept a booking of a passenger where there is an unacceptable risk to the party or to the vessel in doing so.
     

Children
 

  • Children are the sole responsibility of their parents.  Aquaholics do not offer a child minding service.
     

Disclaimer
 

  • Aquaholics and its staff will not be held liable for death, personal injury, loss or damage to property howsoever. The charterer hereby releases, to the full extent permitted by state, law and equity, Aquaholics and their employees and agents from all actual and contingent liability in respect of such personal injury, death, loss or damage not the responsibility of Aquaholics or the crew. 

  • It shall be the responsibility of the Charterer to make passengers aware that they travel on the vessel subject to these Terms and Conditions.

  • Aquaholics operation of the Maeflower will be subject to and in-line with the current Covid-19 regulations as ordered by the HK Government.
